NOTIFICATION: AUTHORISATION DENIED FOR THE PROPOSED TOWNSHIP
ESTABLISHMENT ON PORTION 2 OF THE FARM RIETFONTEIN 375 JR: RIETVLEI
VISTA
In terms of Regulation 10(2) of the 2010 Amended NEMA EIA Regulations
the EAP must notify all registered interested and affected parties
within 12 days of the Department’s Decision (Gauteng Department of
Agricultural and Rural Development (GDARD)). This correspondence
represents the formal notification of Interested and Affected Parties.
PROJECT REFERENCE: GAUT: 002/09-10/N0435
APPLICANT: Dwelling Developments (Pty) Limited
LOCATION: The site for the proposed development is situated East
the R50 Delmas Road and the Rietvlei Dam Nature Reserve, South of the
Mooikloof Ridge Residential Estate
DATE OF ENVIRONMENTAL AUTHORISATION ISSUED: 23 April 2012
The Department made the following findings:
The proposed township is located within the 300m buffer zone of the
Rietvlei Dam (Protected Area Level 2). The detrimental edge effects
associated with the proposed development will improperly affect the
Rietvlei Dam Nature Reserve. Edge effects can physically degrade
habitat, endanger resident biota and reduce the functional size of
protected areas and may include the effect of invasive plant and animal
species, physical damage and soil compaction caused through trampling
and harvesting, abiotic habitat alterations and pollution. All level 1
and 2 protected areas in Gauteng must therefore be protected by a 1km
buffer zone to filter out these deleterious edge effects.
Furthermore, the proposed development is incompatible with the type of
developments considered appropriate in the first 300m buffer zone
(minimal use zone) of protected areas Level 1 and 2. Only grazing and
low impact tourism and residential development (<5% of a property)
are considered appropriate land uses in the minimal use zone.
The need and desirability of the proposed development doesn’t supersede
the need to properly manage development in the area by making sure it
is harmonious with the principles of sustainable development.
In view of the above, and because the nature of the proposed
development is not the best available alternative for development on
the selected site, the development is not supported. Accordingly, the
Department is of the opinion that environmental authorisation
would result in a negative environmental impact conflicting with the
general objectives and principles of integrated environmental
management laid down in Chapter 5 of the NEMA. In addition the
detrimental environmental impacts resulting from the proposed
development cannot be mitigated to acceptable levels.
This application is accordingly denied.
Your attention is drawn to Chapter 7 of the Regulations. Should you
wish to appeal any aspect of the Decision, you must, inter alia, lodge
a Notice of Intention to Appeal with the Member of the Executive
Council (MEC), within 20 (twenty) days from 23 April 2012, by means of
the following methods:
