RECORD OF DECISION (RoD):
After reviewing the facts and documentation presented to the Department
of Agriculture and Rural Development (GDARD), the Department has, by
virtue of the powers conferred on it by the National Environmental
Management Act, 1998 (Act No. 107 of 1998) and the Environmental Impact
Assessment Regulations, 2006, decided to grand Environmental
Authorisation (hereafter referred to as “the granted”) for the proposed
project. The granted environmental authorisation was issued on 11 March
2010.
The granted authorisation is for the activities as indicated in
the Record of Decision (ROD) which falls within the jurisdiction
of City of Tshwane Metropolitan Municipality. A copy of the ROD and
reasons for the decision is herewith attached.
In reaching its decision, the Department took all the information to their disposal into account.
In terms of Regulation 10(2) of the Environmental Impact
Assessment Regulations, 2006, you are hereby notified of the outcome of
the application as well as reasons for the decision as reached by the
Department. Furthermore, in accordance with Chapter 7 of the
Environmental Impact Assessment Regulations, 2006, a person affected by
this decision who wishes to appeal against the decision, must lodge a
notice of intention to appeal with the MEC within 10 days after that
person has been notified in terms of the Regulations, of the decision.
Once the notice of Appeal has been lodged you will have 30 days within
which to lodge the appeal. There is NO formal forms to submit to GDARD
for such as appeal.
The appeal can be lodged by means of one of the following methods:

Also be informed that if the appellant (the person appealing) is
a person other than the applicant (i.e. the developer), the appellant
must serve on the applicant -
(a) a copy of the notice of intention to appeal lodged with the MEC; and
(b) a notice indicating where and for what period the appeal submission will be available for inspection by the applicant.

Naturally, this is also required if the appellant (the
person appealing) is the applicant (i.e. the developer). In
the case of the developer appealing, you as IAPs will then be informed,

Dear Interested and Affected Party
PROPOSED DEVELOPMENT ON REMAINING EXTENT OF PORTION 330 OF THE FARM DOORNKLOOF 391 JR
We refer to the public participation process for the proposed
establishment of a golf academy and driving range, for which you are a
registered Interested and Affected party.
The Final Basic Assessment Report was submitted to the GDACE
(Gauteng Department of Agriculture Conservation and Environment) in
July 2008. The GDACE has however rejected the report. They requested
additional information dealing mainly with the format of the report.
In the meantime the applicant (Centurus Projects) has sold the
land to MNT Development. The new applicant intends to submit the final
amended Basic Assessment Report to the GDACE within the next two weeks.
The development proposal has however changed from a “golf academy and
driving range” to a “mixed use and medium density residential
development.” Please refer to the attached map which indicates the
locality of the site as well as the proposed uses in relation to the
larger area. The site is indicated in orange.
The commercial uses will be clustered around Nellmapius Road, while the
residential component will probably be adjacent to Cornwall Hill.
If you wish to comment on the change in scope of the project, please
submit your issues/concerns, in writing, to our offices at your
earliest convenience.
