NOTICE OF AUTHORISATION
IN TERMS OF THE ENVIRONMENTAL IMPACT
ASSESSMENT REGULATIONS, 2010
Notice is given that, in terms of regulation no. R.543 published in the
Government Notice no. 33306 of 18 June 2010 of the National Environment
Management Act, 1998 (Act No. 107 of 1998) the Gauteng Department of
Agriculture and Rural Development has granted Authorization for JR 209
Investment (Pty) Ltd to continue with the proposed development.
Name of project: Sterkfontein Phase 1B
Reference: Gaut 002/09-10/N0571
Project description: Establishment of a township comprising of:
(a) Industrial uses/buildings including offices and
showrooms (FSR 0.6, coverage 60 %,Height 3 storeys) as well as
(b) Shops, commercial uses, Industrial uses/buildings
including offices and showrooms (FSR 0.6, coverage 60%, Height 3
storeys)
Date of authorization: 27 July 2010
Reasons for the decision:
· In terms of Ekurhuleni
Metropolitan Municipality Environmental Management Framework (EMM
EMF 2008), the proposed site is situated I an area zoned for Open
space, Industrial and Residential, therefore, the proposed development
is compatible with the surrounding land uses.
· The proposed site is
severely disturbed and is overgrown with weeds and invaders,
particularly exotic Blue Gum trees.
· The public participation
process was conducted in accordance with the Department’s requirements.
· An EMP is provided in the
report which takes into consideration possible environmental impacts
that could arise during all the phases on the proposed activity and
mitigation measures were provided.

NB: Please note that an appeal may be lodged against the
decision made by the Department in terms of Chapter 7 of Regulation R.
543. According to Regulation R. 543 Section 60(1) the notice of
intention to appeal must be submitted within 20 days from the date of
this notice. Thereafter according to Regulation R. 543 Section 62(1)
the formal appeals must be submitted to the relevant department within
30 days after the lapsing of the 20 days contemplated in regulation
60(1) above.
The notices of appeals must be lodged no later than 16 August 2010.

Please note that two extra activities in terms of regulation no.
R385 published in the Government Notice no. 28753 of 21 April 2006 of
the National Environment Management Act, 1998 (Act No. 107 of 1998)
governing Basic Assessment procedures (Notice 1-Governing Notice R386)
were added to the proposed Sterkfontein Phase 1D (Gaut 002/09-10/N0570)
project.
According to GDARD (Gauteng Department of Agriculture and Rural
Development) a non-perennial river is present on the site, which is why
the additional activities were included in the application. Attached is
